WARRANTY DISCLAIMER

Effective Date: January 1, 2026

NO WARRANTIES OF ANY KIND – ONLINE AND IN-STORE SALES

R/R Sports International, Inc. d/b/a Blaze Powersports and Outdoors (“Seller”), including its officers, directors, employees, contractors, agents, agents, and affiliates, sells all products and vehicles strictly “AS IS” and “AS AVAILABLE,” whether purchased online, in-store, by phone, special order, consignment, or by any other method.

Seller makes NO express, implied, statutory, or other warranties of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, durability, workmanship, habitability, non-infringement, or performance. No manufacturer warranty is adopted or extended by Seller unless expressly stated in writing.

All goods are sold without warranty except as expressly stated below under Warranty of Title.

WARRANTY OF TITLE ONLY (RECREATIONAL VEHICLES)

Seller warrants only that it holds good and marketable title to recreational vehicles sold and that such title is transferred free and clear of known liens and encumbrances at the time of sale.

NO other warranties apply to recreational vehicles, including but not limited to ATVs, dirt bikes, go-karts, scooters, UTVs, used vehicles, consignment units, or any motorized recreational equipment.

RECREATIONAL VEHICLES – SOLD AS IS

All recreational vehicles are sold strictly AS IS, WITH ALL FAULTS.

Seller expressly disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.

Buyer acknowledges that recreational vehicles are mechanical products subject to wear, required maintenance, adjustment, and potential mechanical failure. Buyer accepts full responsibility for inspection prior to purchase and for all repairs, service, transportation, maintenance, storage, and operational costs after sale.

UNIVERSAL SCOPE OF DISCLAIMER

This disclaimer applies to all goods sold by Seller, including but not limited to:

• Recreational vehicles (new or used)
• Powersports parts and accessories
• Welding supplies
• Knives, swords, and self-defense items
• Sporting goods
• Toys
• Jewelry
• Tools and shop equipment
• Sandpaper and consumables
• Any other product offered for sale

DAMAGED OR DEFECTIVE PRODUCTS (NON-VEHICLE ITEMS)

The rights, remedies, and procedures applicable to damaged or allegedly defective non-vehicle items differ between online sales and in-store sales.

ONLINE SALES

For purchases completed through Seller’s website or other remote ordering methods, separate statements of rights, remedies, conditions, and procedures apply and may differ from those applicable to in-store transactions.

Online buyers must strictly comply with the Returns/Exchanges/Damage Claims Policy in effect at the time of purchase, including all notice deadlines, documentation requirements, inspection procedures, and return authorization instructions. Failure to strictly comply with all stated requirements voids any claim.

Seller’s sole and exclusive obligation for any approved online claim, at Seller’s discretion, is limited to either replacement of the item or refund of the purchase price actually paid. No other remedy is available.

IN-STORE SALES

All non-vehicle items purchased in-store are deemed fully inspected, examined, and accepted by buyer at the time of sale.

Except where otherwise expressly required by applicable law, no return, exchange, refund, or remedy is provided for in-store purchases based on alleged damage or defect after the transaction is completed. Any accommodation granted by Seller is voluntary, made solely at Seller’s discretion, and does not create any ongoing obligation, policy, or precedent.

In all cases, Seller’s total liability, if any, shall be strictly limited to the purchase price paid for the specific item in question.

BUYER RESPONSIBILITY

Buyer assumes full and exclusive responsibility for selecting, inspecting, installing, assembling, maintaining, and using any product or vehicle purchased.

Photographs, diagrams, descriptions, verbal statements, showroom discussions, and sales representations are for informational purposes only. No employee, agent, or representative of Seller is authorized to create any warranty or guarantee beyond the Warranty of Title expressly stated herein.

EXCLUSIONS

No warranty or liability applies to damage or failure arising from:

• Improper handling, misuse, abuse, or neglect
• Improper assembly or setup
• Incorrect or unsafe installation
• Interaction with other defective or malfunctioning components
• Alteration, modification, or customization
• Racing, competition, stunt, or commercial use
• Off-road or extreme environment operation
• Lack of maintenance
• Normal wear and tear

NO CONSEQUENTIAL OR INCIDENTAL DAMAGES

Seller shall not be liable for consequential, incidental, indirect, special, exemplary, or punitive damages of any kind, including but not limited to labor costs, repair costs, towing charges, loss of use, property damage, personal injury, death, downtime, lost income, or any other economic or non-economic loss.

TRANSFER OF RISK

For shipped or online purchases, risk of loss transfers to buyer upon delivery of the product to the carrier.

For in-store purchases, risk of loss transfers to buyer immediately upon completion of sale and physical delivery of the product or vehicle.

INHERENT RISK AND INDEMNIFICATION

Certain products and vehicles sold by Seller involve inherent risks, including but not limited to mechanical failure, fire, explosion, electrical shock, bodily injury, property damage, or death. Welding supplies involve additional risks including burns, toxic fumes, and fire hazards. Recreational vehicles involve risks of collision, rollover, mechanical failure, and serious injury.

Buyer acknowledges these dangers and affirms that they possess appropriate training, supervision, and safety equipment prior to use.

Buyer agrees to indemnify, defend, and hold harmless Seller and its officers, directors, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, costs, or legal actions arising from buyer’s possession, assembly, installation, operation, or use of any product or vehicle.

ENTIRE AGREEMENT

This Warranty Disclaimer constitutes the entire agreement regarding warranties for all online and in-store sales. No oral or written statement, representation, promise, or advice creates any warranty not expressly stated herein.
