RESTRICTED PRODUCTS, AGE REQUIREMENTS, AND BUYER RESPONSIBILITY POLICY

This Restricted Products, Age Requirements, and Buyer Responsibility Policy (“Policy”) applies to the sale, purchase, handling, possession, and use of designated restricted products sold by R/R Sports International, Inc., d/b/a Blaze Powersports and Outdoors (“Company”).

This Policy applies to purchases made at the Company's physical retail location and supplements the Company's other applicable policies.

The Company sells certain products that, because of their nature, intended purpose, potential for injury, or legal classification, require responsible ownership, handling, storage, transportation, and use.

Purchasers are responsible for knowing and complying with all federal, state, parish, municipal, and other laws applicable to their purchase, possession, transportation, carrying, storage, transfer, and use of such products.

1. RESTRICTED PRODUCTS

For purposes of this Policy, “Restricted Products” may include, but are not limited to:

  • Knives and other bladed products.
  • Swords.
  • Nunchaku and similar martial-arts weapons.
  • Throwing weapons and similar martial-arts equipment.
  • Blowguns and related equipment.
  • Crossbows and related equipment.
  • Air-powered guns and similar devices.
  • Personal-defense devices.
  • Martial-arts weapons.
  • Other weapons, defensive products, potentially dangerous implements, or products designated by the Company as Restricted Products.

The classification of a product as a Restricted Product under this Policy does not constitute a representation that the product is legally classified as a weapon in every jurisdiction or for every purpose.

The Company may designate additional merchandise as Restricted Products when appropriate for safety, legal compliance, or responsible retail practices.

2. MINIMUM AGE — 18 YEARS

RESTRICTED PRODUCTS WILL NOT BE SOLD TO ANY PERSON UNDER EIGHTEEN (18) YEARS OF AGE.

A purchaser of a Restricted Product must be at least eighteen years old at the time of purchase.

Louisiana law prohibits the sale or delivery for value of certain weapons to persons under eighteen years of age. The Company's policy applies the eighteen-year minimum to all products designated by the Company as Restricted Products.

The Company reserves the right to require valid, unexpired government-issued photographic identification establishing the purchaser's identity and date of birth before completing any Restricted Product transaction.

Failure or refusal to provide satisfactory identification upon request will result in refusal of the sale.

The Company reserves the right to refuse a Restricted Product transaction when Company personnel reasonably believe that the product is actually being purchased for, transferred to, or obtained on behalf of a person who does not satisfy applicable age or legal requirements.

3. BUYER RESPONSIBILITY FOR APPLICABLE LAW

Laws concerning weapons, knives, martial-arts equipment, personal-defense products, air-powered devices, crossbows, and similar products may differ depending upon jurisdiction and circumstances.

The purchaser is responsible for determining whether the purchase, possession, ownership, carrying, transportation, transfer, storage, display, or intended use of a Restricted Product is lawful under all laws applicable to the purchaser and the location where the product will be possessed or used.

A product being offered for lawful retail sale by the Company does not constitute a representation that every purchaser may legally possess, carry, transport, or use that product in every location or circumstance.

Purchasers are responsible for compliance with applicable:

  • Federal law.
  • Louisiana law.
  • Laws of another state when the product is transported outside Louisiana.
  • Parish and municipal ordinances.
  • Laws governing particular locations or facilities.
  • Age restrictions.
  • Carrying and concealment restrictions.
  • Transportation and storage requirements.
  • Hunting, sporting, recreational, or other activity-specific regulations.

The Company does not provide legal advice concerning a purchaser's individual right to possess, carry, transport, transfer, or use a particular product.

4. NO REPRESENTATION OF LEGALITY FOR A PARTICULAR PURCHASER OR USE

The Company's willingness to sell a Restricted Product does not constitute a determination or representation that:

  1. The purchaser may legally possess the product in every jurisdiction.
  2. The purchaser may legally carry the product, openly or concealed.
  3. The purchaser may legally transport the product to another jurisdiction.
  4. The product may lawfully be possessed at every location.
  5. The purchaser's intended use is lawful.
  6. The purchaser possesses any license, permit, training, qualification, or authorization that may be required for a particular activity.
  7. The product is appropriate or safe for every intended use.

The purchaser remains responsible for determining the legality of his or her possession and intended conduct.

5. SAFE HANDLING AND STORAGE

Restricted Products can cause serious injury, death, or property damage if handled, stored, transported, or used improperly.

Purchasers are responsible for becoming familiar with the safe handling and operation of any Restricted Product before using it.

Purchasers should follow all manufacturer instructions, warnings, safety information, and recommended maintenance and storage procedures supplied with a product.

Restricted Products should be stored securely and responsibly, particularly when children, minors, unauthorized persons, or persons unfamiliar with the product may otherwise gain access to them.

A purchaser should not use a Restricted Product while impaired by alcohol, illegal drugs, medication that materially impairs safe judgment or coordination, or any other substance or condition that prevents safe handling.

6. TRAINING AND RESPONSIBLE USE

Products intended for martial arts, sporting, recreational, defensive, or similar activities may require specialized knowledge or training for safe use.

Purchasers who are unfamiliar with the safe handling or operation of a Restricted Product should obtain appropriate instruction before attempting to use it.

Where applicable, training by a qualified instructor or other knowledgeable professional is strongly recommended.

The sale of a product by the Company does not constitute training, certification, or a representation that the purchaser possesses the skill necessary to safely use the product.

7. ASSUMPTION OF RISKS ASSOCIATED WITH HANDLING AND USE

The purchaser acknowledges that knives, swords, martial-arts weapons, crossbows, air-powered guns, personal-defense products, and other Restricted Products may present inherent risks of serious bodily injury, death, or property damage.

The purchaser is responsible for exercising reasonable care when possessing, handling, storing, transporting, maintaining, or using such products.

To the fullest extent permitted by applicable law, the purchaser assumes the ordinary and inherent risks associated with the purchaser's possession, handling, storage, transportation, and lawful use of the Restricted Product.

Nothing in this Policy is intended to waive, exclude, or limit liability where such waiver, exclusion, or limitation is prohibited by applicable law.

8. MISUSE, NEGLIGENCE, RECKLESS CONDUCT, AND UNLAWFUL USE

The Company does not authorize, encourage, or condone the unlawful, negligent, reckless, threatening, abusive, or intentionally harmful use of any Restricted Product.

Purchasers must not use Restricted Products:

  • To commit or facilitate a crime.
  • To unlawfully threaten, intimidate, assault, or injure another person.
  • In a negligent or reckless manner.
  • In violation of applicable weapons laws.
  • In locations where possession or use is prohibited.
  • In a manner inconsistent with applicable manufacturer safety instructions.
  • In any other manner prohibited by law.

The purchaser is responsible, to the extent provided by applicable law, for injuries, property damage, losses, penalties, or other consequences resulting from the purchaser's own unlawful, negligent, reckless, intentional, or otherwise wrongful conduct.

9. THIRD-PARTY ACCESS AND TRANSFER

Purchasers are responsible for maintaining reasonable control over Restricted Products following purchase.

Restricted Products should be stored in a manner reasonably designed to prevent unauthorized access, particularly access by minors.

A purchaser is responsible for determining whether any subsequent transfer, gift, loan, sale, or other delivery of a Restricted Product to another person is permitted by applicable law.

A purchaser must not purchase a Restricted Product for the purpose of circumventing an age restriction or other legal restriction applicable to another person.

10. IN-STORE HANDLING OF RESTRICTED PRODUCTS

Customers and visitors may not remove Restricted Products from displays, packaging, cases, secured areas, or other storage locations when Company personnel have restricted customer access to those products.

Customers must comply with instructions from Company personnel concerning the inspection or handling of Restricted Products.

A customer who is permitted to inspect a Restricted Product must handle it responsibly and return it immediately upon request.

Horseplay, threatening conduct, brandishing, intentional misuse, or unsafe handling of a Restricted Product on Company premises is prohibited.

The Company may immediately terminate the transaction, refuse service, require the person to leave the premises, and contact law enforcement when circumstances warrant.

11. RIGHT TO REFUSE SALE

The Company reserves the right, to the extent permitted by applicable law, to refuse or discontinue a Restricted Product transaction.

A sale may be refused when, among other circumstances:

  • The purchaser cannot establish that he or she is at least eighteen years old.
  • Requested identification is unavailable, expired, altered, inconsistent, or otherwise unsatisfactory.
  • Company personnel reasonably believe the product is being purchased for an underage person.
  • The purchaser indicates an unlawful intended use.
  • The purchaser engages in threatening, violent, intoxicated, reckless, suspicious, or unsafe behavior.
  • The purchaser refuses to comply with reasonable safety requirements.
  • Completing the transaction may violate applicable law.
  • Company personnel determine that completing the transaction would present a material safety concern.

The Company is not obligated to complete a Restricted Product transaction merely because the product is displayed, priced, advertised, or otherwise offered as merchandise.

12. PRODUCT CONDITION, WARNINGS, AND MANUFACTURER INSTRUCTIONS

Purchasers are responsible for inspecting Restricted Products as appropriate and following all warnings, instructions, manuals, labels, safety information, and maintenance requirements supplied by the manufacturer.

Customers must not remove, obscure, alter, or disregard manufacturer safety warnings.

The purchaser should discontinue use of a product that appears damaged, defective, improperly assembled, or unsafe and seek appropriate assistance before further use.

Nothing in this section alters any rights or remedies that cannot lawfully be waived or limited.

13. MODIFICATION OF PRODUCTS

Modification of a Restricted Product may affect its safety, operation, legality, warranty coverage, or suitability for its intended purpose.

The Company is not responsible for unauthorized modifications, alterations, disassembly, removal of safety devices, improper repairs, or other changes made to a Restricted Product after sale except to the extent responsibility is imposed upon the Company by applicable law.

The purchaser is responsible for determining whether a modification is lawful and safe before making or permitting such modification.

14. COMPLIANCE WITH LAW ENFORCEMENT AND LEGAL REQUIREMENTS

The Company reserves the right to comply with lawful requests, orders, subpoenas, reporting obligations, or other requirements imposed by law enforcement agencies, courts, governmental authorities, insurers, or applicable law.

The Company may preserve transaction information, surveillance recordings, identification information lawfully collected during a transaction, or other records when reasonably necessary for legal compliance, investigation of an incident, preservation of evidence, or protection of the Company's legitimate interests, subject to applicable law and the Company's Privacy Policy.

15. NO EXPANSION OF COMPANY DUTIES OR WAIVER OF DEFENSES

Nothing in this Policy shall be interpreted as:

  1. An admission that every Restricted Product is legally classified as a dangerous weapon.
  2. A representation that a Restricted Product is lawful for every purchaser, jurisdiction, location, or intended use.
  3. An assumption by the Company of a legal duty greater than that imposed by applicable law.
  4. A waiver by the Company of any defense, limitation, burden of proof, comparative-fault right, third-party-fault right, or other protection available under applicable law.
  5. An attempt to exclude or limit liability where such exclusion or limitation is prohibited by law.

If any provision of this Policy is determined to be invalid or unenforceable, the remaining provisions shall remain effective to the fullest extent permitted by applicable law.

16. RELATIONSHIP TO OTHER COMPANY POLICIES

This Policy supplements and should be read together with the Company's:

Premises Safety, Customer Conduct, Video Surveillance, and Restricted Shop Access Policy

and any other applicable Company policies.

The Company's premises rules remain fully applicable to customers inspecting, purchasing, possessing, or handling Restricted Products while on Company property.

In the event different Company policies address the same subject, they shall be interpreted together to the fullest extent reasonably possible and consistent with applicable law.

17. GOVERNING LAW

This Policy shall be governed, interpreted, and applied in accordance with the laws of the State of Louisiana and applicable federal law.

If any provision conflicts with applicable law, applicable law shall control and the remaining provisions shall continue to apply to the fullest extent permitted by law.
