Premises Liability, Customer Conduct, and Shop Access Policy
PREMISES SAFETY, CUSTOMER CONDUCT, VIDEO SURVEILLANCE, AND RESTRICTED SHOP ACCESS POLICY
Effective Date: January 1, 2026
This Premises Safety, Customer Conduct, Video Surveillance, and Restricted Shop Access Policy (“Policy”) applies to all customers, visitors, guests, vendors, delivery persons, accompanying minors, and other non-employees entering or remaining upon the premises of R/R Sports International, Inc., d/b/a Blaze Powersports and Outdoors (“Company”).
All persons entering the premises are expected to exercise reasonable care for their own safety and the safety of others, comply with posted warnings and instructions from Company personnel, remain within areas open to customers and visitors, and refrain from conduct that creates an unreasonable risk of injury or property damage.
1. GENERAL PREMISES SAFETY
Blaze Powersports and Outdoors is an operating powersports retail and service business. The premises may contain motorcycles, ATVs, dirt bikes, go-karts, scooters, engines, parts, merchandise, displays, ramps, curbs, doors, equipment, tools, fluids, loading and unloading areas, vehicles being moved, and other conditions ordinarily associated with a powersports retail and service facility.
Customers and visitors must exercise reasonable care while walking through, entering, exiting, or otherwise using the premises.
Running, horseplay, climbing on vehicles or displays, interfering with equipment, moving merchandise without authorization, entering unauthorized areas, or otherwise engaging in unsafe conduct is prohibited.
Customers and visitors must comply with all signs, barriers, cones, floor markings, warnings, restricted-area notices, and reasonable verbal safety instructions provided by Company personnel.
2. 24-HOUR VIDEO SURVEILLANCE AND RECORDING
NOTICE: THE INTERIOR AND EXTERIOR AREAS OF R/R SPORTS INTERNATIONAL, INC., D/B/A BLAZE POWERSPORTS AND OUTDOORS, ARE SUBJECT TO 24-HOUR VIDEO SURVEILLANCE AND RECORDING, SEVEN DAYS A WEEK.
Video surveillance is maintained for safety, security, loss prevention, protection of persons and property, incident investigation, and other legitimate business purposes.
Surveillance cameras may monitor and record, where installed and permitted by applicable law:
Customer and retail areas.
Entrances and exits.
Parking and vehicle areas.
Exterior areas and building perimeters.
Service-related and restricted areas.
Storage and merchandise areas.
Other areas of Company premises where surveillance equipment is installed.
Video recordings may be reviewed, copied, preserved, and retained by the Company for legitimate business and legal purposes, including:
Investigation of accidents, injuries, slips, trips, and falls.
Investigation of property damage.
Theft, attempted theft, vandalism, or suspected unlawful activity.
Harassment, sexual harassment, threats, violence, or other prohibited conduct.
Unauthorized entry into restricted areas.
Customer or employee safety.
Insurance claims and investigations.
Investigation of disputes or reported incidents.
Preservation of evidence relating to an actual or reasonably anticipated claim, dispute, insurance matter, or legal proceeding.
Cooperation with law enforcement, insurers, attorneys, courts, governmental authorities, or other persons when disclosure is authorized or required by applicable law.
The existence of surveillance equipment does not constitute a representation or guarantee that every location, person, activity, event, or incident will be captured or recorded, that every camera will operate without interruption, or that recordings will be retained for any particular period unless retention is required by applicable law or the Company determines that preservation is appropriate.
Customers and visitors must not tamper with, obstruct, cover, damage, disable, reposition, interfere with, or intentionally block any camera, recorder, security device, or other surveillance equipment.
Video surveillance will not intentionally be conducted in areas where individuals have a legally protected reasonable expectation of privacy.
3. SLIPS, TRIPS, FALLS, AND OTHER PREMISES CONDITIONS
Customers and visitors are expected to watch where they are walking and exercise reasonable care appropriate to their surroundings.
Anyone who observes a spill, wet area, obstruction, debris, damaged or uneven surface, unstable merchandise, or any other condition that may present a safety concern should immediately notify Company personnel and avoid the affected area.
Customers and visitors must not enter, cross, bypass, move, or disregard any area that has been barricaded, marked, closed, restricted, or identified as potentially hazardous.
Nothing in this Policy is intended to eliminate or limit any duty imposed upon the Company by applicable Louisiana law.
The Company expressly reserves all defenses, limitations, burdens of proof, comparative-fault rights, third-party-fault rights, and other protections available under Louisiana law with respect to claims involving the premises or activities occurring thereon.
4. RESPONSIBILITY FOR PROPERTY DAMAGE
Customers and visitors are responsible, to the extent provided by applicable law, for damage to Company property caused by their intentional acts, negligence, reckless conduct, misuse, unauthorized handling, or failure to follow Company instructions.
This includes, where applicable, damage to merchandise, vehicles, parts, equipment, displays, fixtures, tools, furnishings, buildings, and other Company property.
The Company reserves the right to seek the reasonable cost of repair or replacement and any other damages recoverable under applicable law from persons legally responsible for such damage.
Nothing in this section prevents the Company from contacting law enforcement or pursuing available civil or criminal remedies when property is intentionally damaged, vandalized, stolen, unlawfully removed, or otherwise subjected to unlawful conduct.
5. CHILDREN AND MINORS
Parents, legal guardians, and accompanying responsible adults must maintain direct and appropriate supervision of minors in their care at all times while on Company premises.
Children and minors may not:
Run or engage in horseplay on the premises.
Climb or play on vehicles, equipment, merchandise, fixtures, or displays.
Start or attempt to start any vehicle or equipment.
Operate or manipulate throttles, brakes, switches, controls, gear selectors, ignition systems, or other vehicle or equipment controls.
Handle tools or service equipment.
Enter restricted areas.
Interfere with Company employees or business operations.
Powersports vehicles, equipment, displays, and merchandise are not playground equipment.
The Company may require a parent, guardian, or responsible adult to immediately remove a minor from the premises when the minor’s conduct creates a safety risk, threatens property, interferes with business operations, or violates this Policy.
Responsibility for injury or property damage involving a minor shall be determined in accordance with applicable Louisiana law.
6. SERVICE SHOP — AUTHORIZED EMPLOYEES ONLY
THE SERVICE SHOP IS A RESTRICTED WORK AREA. AUTHORIZED COMPANY EMPLOYEES ONLY.
The Company’s insurance requirements restrict access to the service shop to authorized Company employees.
Customers, visitors, guests, family members, friends, vendors, delivery persons, and other non-employees are prohibited from entering the service shop.
This restriction applies even when a customer’s own vehicle, unit, equipment, merchandise, or personal property is located inside the service shop.
Customers and other non-employees may not enter the service shop to:
Observe repairs or diagnostics.
Inspect work in progress.
Retrieve personal property.
Speak with a technician at a work station.
Assist with repairs or maintenance.
Inspect their vehicle while work is being performed.
Use Company tools or equipment.
Enter for any other purpose.
Questions concerning service work, diagnostics, estimates, repairs, maintenance, preparation, or a customer’s vehicle must be handled from an authorized customer area through Company personnel.
Doors, gates, counters, barriers, ropes, chains, cones, signs, floor markings, or other methods used to identify the service shop or another restricted area must not be crossed, moved, bypassed, or disregarded.
Any unauthorized person entering the service shop or another restricted area will be instructed to leave the restricted area immediately and may be required to leave the premises.
7. CUSTOMER REPAIRS AND MECHANICAL WORK
Customers and visitors are prohibited from performing mechanical repairs, maintenance, diagnostics, disassembly, adjustments, modifications, fluid changes, electrical work, or similar mechanical work on Company premises unless the Company has expressly designated an area and particular activity for that purpose.
Customers and visitors may not use Company tools, lifts, jacks, diagnostic equipment, machinery, work benches, electrical equipment, compressed-air equipment, service equipment, or other Company property without express authorization.
Under no circumstances does authorization to perform an activity in a customer-accessible area constitute authorization to enter the employees-only service shop.
8. VEHICLES, POWERSPORTS UNITS, AND EQUIPMENT
Customers and visitors may not start, operate, move, mount, sit upon, climb upon, or manipulate the controls of a powersports vehicle or other equipment unless expressly authorized by Company personnel.
Authorization to inspect, touch, or sit upon a particular vehicle does not constitute authorization to start, operate, move, or otherwise control that vehicle.
Keys, ignition systems, switches, throttles, brakes, gear selectors, steering controls, electrical controls, and other operating controls must not be manipulated without authorization.
Customers and visitors must immediately comply with reasonable instructions from Company personnel concerning the inspection, handling, movement, or operation of vehicles, merchandise, or equipment.
9. CUSTOMER AND VISITOR CONDUCT
All customers, visitors, guests, vendors, delivery persons, and other individuals on Company premises are expected to conduct themselves in a lawful, respectful, and safe manner.
The following conduct is prohibited:
Fighting, assault, threats, intimidation, stalking, bullying, or other violent, threatening, or disruptive behavior.
Harassment of Company employees, family members, contractors, customers, visitors, vendors, or any other person on the premises.
Sexual harassment or sexually inappropriate conduct of any kind, including unwanted sexual comments, remarks, propositions, requests, advances, gestures, displays, touching, physical contact, or other unwelcome verbal, visual, or physical conduct of a sexual nature.
Obscene, abusive, threatening, sexually explicit, or seriously offensive conduct directed toward Company employees, family members, contractors, customers, visitors, vendors, or other persons.
Intentional or reckless damage to property.
Theft or attempted theft.
Unsafe operation or unauthorized movement of vehicles or equipment.
Interference with employees performing their duties.
Entry or attempted entry into restricted areas.
Refusal to comply with reasonable safety or access instructions.
Conduct creating an unreasonable risk of injury or property damage.
Unlawful activity of any kind.
The Company reserves the right, subject to applicable law, to immediately refuse or discontinue service and require any person engaging in prohibited conduct to leave the premises.
When circumstances warrant, the Company may contact law enforcement, issue or seek enforcement of a trespass restriction, preserve surveillance recordings or other evidence, document the incident, and pursue any civil or criminal remedies available under applicable law.
10. PERSONAL PROPERTY
Customers and visitors are responsible for maintaining reasonable control of their personal property while on Company premises.
The Company is not responsible for ordinary loss, misplacement, or theft of unattended personal property except to the extent responsibility is imposed upon the Company by applicable law.
Personal property must not be placed or left in aisles, entrances, exits, walkways, work areas, or other locations where it could create an obstruction or safety hazard.
11. ACKNOWLEDGMENT OF ORDINARY AND INHERENT RISKS
Persons entering a functioning powersports retail and service facility acknowledge that the environment necessarily involves vehicles, machinery, equipment, merchandise, tools, vehicle movement, loading and unloading activities, and other ordinary conditions associated with such a business.
Customers and visitors are responsible for exercising reasonable care for their own safety and for complying with posted warnings, barriers, restricted-area designations, and reasonable safety instructions.
Nothing in this provision is intended to waive, exclude, or limit liability where such waiver, exclusion, or limitation is prohibited by Louisiana law.
12. CUSTOMER’S AND VISITOR’S OWN CONDUCT
Nothing in this Policy relieves a customer or visitor from responsibility for his or her own negligent, reckless, intentional, unlawful, or unsafe conduct.
To the fullest extent permitted by Louisiana law, the Company reserves the right to assert comparative fault, third-party fault, assumption of risk where legally applicable, failure to exercise reasonable care, failure to heed posted warnings or verbal instructions, unauthorized entry into restricted areas, misuse of vehicles, merchandise, equipment or property, and every other defense, limitation, or protection available under applicable law.
Where the acts or omissions of a customer, visitor, accompanying person, or third party cause or contribute to an accident, injury, loss, or property damage, responsibility shall be determined in accordance with applicable Louisiana law.
13. ACCIDENTS, INJURIES, FALLS, PROPERTY DAMAGE, AND UNSAFE CONDITIONS
Any accident, injury, slip, trip, fall, collision, property damage, spill, or other safety-related incident occurring on Company premises should be reported to Company personnel immediately.
Whenever reasonably possible, an incident should be reported before the person involved leaves the premises so Company personnel have an opportunity to identify the location, document the circumstances, inspect the area, preserve relevant surveillance recordings or other evidence, identify witnesses, and address any condition requiring attention.
Customers and visitors are requested to identify the exact location and nature of any condition they believe caused or contributed to an incident.
Persons involved in or witnessing an incident may be asked to provide reasonable identifying and contact information and a factual description of what occurred.
The Company may photograph or otherwise document the location, property, vehicles, merchandise, or other physical circumstances associated with a reported incident and may preserve relevant surveillance recordings.
Nothing in this section alters any legal right, duty, burden of proof, reporting requirement, or obligation established by applicable law.
14. REMOVAL FROM PREMISES AND REFUSAL OF SERVICE
Subject to applicable law, the Company reserves the right to refuse or discontinue service and require a person to leave the premises when that person:
Violates this Policy.
Disregards safety instructions.
Enters or attempts to enter a restricted area.
Engages in threatening, violent, harassing, sexually inappropriate, disruptive, or unlawful conduct.
Threatens persons or property.
Intentionally or recklessly damages property.
Interferes with Company employees or business operations.
Creates an unreasonable safety risk.
Refuses to comply with reasonable instructions concerning conduct or access to Company property.
Where appropriate, the Company may contact law enforcement.
A person whose authorization to remain on private Company premises has been withdrawn must leave the premises.
15. NO ADMISSION, EXPANSION OF DUTY, OR WAIVER OF DEFENSES
This Policy establishes rules governing conduct, safety, and access to Company premises.
Nothing contained in this Policy shall be interpreted as:
An admission by the Company that any particular condition is dangerous, hazardous, or defective.
An admission of negligence, fault, notice, knowledge, or liability concerning any condition or occurrence.
An assumption by the Company of any duty greater than that imposed by applicable law.
A waiver by the Company of any defense, burden of proof, comparative-fault right, third-party-fault right, limitation, immunity, or other protection available under applicable law.
An attempt to exclude or limit liability where such exclusion or limitation is prohibited by Louisiana law.
A representation or guarantee that the premises are or will remain completely free from all risks or hazards.
The Company’s investigation, documentation, correction, cleanup, repair, warning, preservation of surveillance recordings, or other response to a reported or observed condition shall not, by itself, constitute an admission of negligence, fault, prior notice, knowledge, or liability.
If any provision of this Policy is determined to be invalid or unenforceable, the remaining provisions shall remain effective to the fullest extent permitted by applicable law.
16. COMPANY AUTHORITY AND SAFETY INSTRUCTIONS
Company management reserves the right to establish and enforce reasonable additional safety, access, and conduct requirements based upon conditions or circumstances occurring on the premises.
Customers and visitors must promptly comply with reasonable instructions provided by Company personnel concerning:
Safety.
Restricted areas.
Vehicle or equipment handling.
Customer access.
Protection of persons or property.
Emergency conditions.
Business operations.
Failure to comply may result in refusal or discontinuation of service and removal from the premises, subject to applicable law.
17. GOVERNING LAW
This Policy shall be governed, interpreted, and applied in accordance with the laws of the State of Louisiana.
If any provision of this Policy conflicts with applicable Louisiana or federal law, applicable law shall control, and the remaining provisions shall continue to apply to the fullest extent permitted by law.
